Context: 

The Supreme Court directed the chairperson of the National Commission for Homoeopathy (NCH) to step down from his post as his appointment was not in accordance with the law.

The order came on a plea filed by Dr Amaragouda L Patil (an applicant for the same post) challenging the appointment of the current chairman of NCH.

The appointment was challenged on the grounds that the chairperson of the NCH did not possess the requisite experience required under Sections 4(2) and 19 of the National Commission for Homeopathy Act, 2020, respectively.

• Section 4(2) and Section 19 of the National Commission for Homeopathy Act, 2020, mandate a minimum of 20 years of experience, including at least 10 years in a leadership role.
• The term “leader” here means the Head of a Department or the Head of an Organisation.

National Commission for Homoeopathy (NHC) 

NCH was constituted in 2021 by an act of Parliament known as the National Commission for Homoeopathy Act, 2020.

NCH under the Ministry of Ayush by its notification in 2021 repealed the earlier Homoeopathy Central Council Act, 1973.

NCH encourages Homoeopathy Medical professionals to adopt the latest medical research and contribute to research in Homoeopathy. 

The aims of The National Commission for Homoeopathy (NCH) are: 

• To improve access to quality and affordable medical education in Homoeopathy, 
• To ensure the availability of adequate and high-quality Homoeopathy medical professionals in all parts of the country; (
• To promote equitable and universal healthcare that encourages community health perspective and makes services of Homoeopathy medical professionals accessible and affordable to all citizens

Composition of Commission: The Commission shall consist of the following persons.

• A Chairperson
• seven ex officio Members (appointed by central govt)
• nineteen part-time Members (also appointed by the central govt)
